The following themes will be dealt with in the seminar methodology of law:
• looking up and consulting legislation, jurisdiction and legal theory (library, databases, ...);
• processing legal sources and compiling them into a jurisprudential text;
• source acknowledgment and citation (bibliography in footnotes and endnotes) according to the V&A guidelines;
• methods to analyse jurisdiction, comprising among others judgments of the Court of Cassation
• initiation to legal practice, more specifically the prison system and the profession of bailiff;
• initiation to advocating and conclusion writing.

Seven seminars will take place, distributed between the two semesters. They are held every two weeks at a fixed time, based on the grouping, the rotation schedule and the seminars Methodology of law, Legal writing and Legal English. Attending these seminars is mandatory. A calendar is made available on Toledo, offering an overview of the seven seminars and the weeks in which they take place. The grouping and rotation scheme will also be posted on Toledo.

In addition, several lectures will be held and announced accordingly on Toledo.

Students will write a legal paper in pairs or groups of three, called rechtsvraag (legal question). They will be guided by a rechtsvraag supervisor. After submission, students will defend their paper orally during a simulated trial in the presence of a magistrate.

Students take part in a prison visit and follow a one day internship with a bailiff. Students enroll for this in accordance with the procedure as outlined on Toledo.

The neutral report (legal paper), including the oral defense, counts for 14 out of 20 points.

The written exam counts for 6 out of 20 points. The exam consists of questions about the content of the seminars and the lectures, as well as an analysis of a judicial opinion.

Points will be deducted of the final grade if the student, without a valid reason (i.e. illness or force majeure, with proof):

- is absent in the seminar;

- if absent in the seminar, does not participate in a different seminar (of the same content) or does not turn in, in a timely manner, an assignment given in order to achieve the same learning goals of the seminar;

- does not take part in a visit at a prison;

- does not complete a bailiff’s traineeship;

- does not participate in the pleading session (oral defense).

Three unexcused absences will result in a zero grade for the entire course, except in circumstances beyond the student’s control. Such exceptions are at the discretion of the course coordinator, without prejudice to the authority of the ombudsperson to reschedule exams for serious reasons.

In case of a FAIL MARK for this course, tolerance credit cannot be used.

The second examination opportunity in the third examination period is as follows. The partial grades of the written exam from the first sitting period are not transferable to the second sitting period. The student therefore takes the written exam again. With regard to the partial grades of the neutral report (legal paper), the student has the choice of whether or not to resubmit. If the student submits a new neutral report, the neutral report must contain a clear progress. The absence of an improvement implies that the student has not followed the feedback given to him, which leads to a lower grading. There is no new provisional version, peer review or oral defense in the second term; those elements therefore do not count for the final grade.

In case of a FAIL MARK for this course, tolerance credit cannot be used.
