Aims
Learning goals
The student acquires a good understanding of privacy and data protection law and principles and gains an overview of the regulatory framework on the European and national level and the principles applicable to personal data processing in various domains.
S/he is able to analyse legal texts and case law in this domain and can apply the privacy and data protection principles and rules to solve legal questions arising from practical cases. (Competence level 3)
This course contributes to the following learning outcomes:
- The student masters the structure and methodology of the international and European and / or Belgian intellectual property rights, media and / or ICT law that he / she has followed.
- The student can deal with complex problems in the domain of the intellectual property rights, media and / or ICT law that he / she has followed.
- The student can independently test research findings and situate them in a personally substantiated structure that makes an original contribution to knowledge.
- The student can communicate his point of view to colleagues in Dutch, French and / or English

Content
This course on European Privacy and Data Protection Law clarifies the privacy and data protection rights based on Article 8 of the European Convention of Human Rights and the provisions 7 and 8 of the EU Charter of Fundamental Rights, and as developed in case law of the European Court of Human rights and European Court of Justice and national courts.
The course further explains the principles, the rights and the obligations of data protection law as developed in EU Member States over the years and as laid down in international conventions, European Regulations and Directives (in particular the Regulation (EU) 2016/679, the ePrivacy Directive (2002/58/EC), and Directive (EU) 2016/680). Opinions and advice of regulatory bodies and case law will be studied as well.
A closer look will be taken to some privacy and data protection rules in public and private organizations in particular domains (e.g., health) or in relation with specific technologies (e.g., artificial intelligence technologies) via lectures, problem-based learning and class discussions.
Practical application of the knowledge and insights gained will be exercised as well in order to develop the legal skills required for the implementation of privacy and data protection rules.

The course will be a combination of classes by the named lecturers and, for particular topics, invited experts from the field, and hands-on workshops by the students.
Students will be asked to read preparatory materials provided by the lecturers and to participate in the class discussions.
