Learning goals

Students thoroughly understand the international patent law regime and the European patent law system, including legislation, case law and relevant legal doctrine. Students understand the latest developments in the domain of international and European patent law.


This course contributes to the following learning outcomes:

  • The student can deal with complex problems in the domain of the intellectual property rights, media and/or ICT law that he/she has followed.
  • The student can independently test research findings and situate them in a personally substantiated structure that makes an original contribution to knowledge.
  • The student can adopt a critical position in relation to the domain of the intellectual property law rights, media law and/or IT law that he/she has followed.
  • The student can communicate his point of view to colleagues in Dutch, French and/or English.

The major objective of this course is to provide an in-depth analysis of the international and European patent law system. In addition, this course examines some topical aspects in current patent law.

The first and major part of the course focuses on the law and case law based on the European Patent Convention. Particular attention is drawn to patentable subject matter, patentability requirements, granting and appeal procedures, scope of protection and rights of patentees.

During the second part of the course attention is drawn to some important (topical) issues in current patent law, such as ‘Patent protection and life sciences’, ‘Patent protection and technology’, ‘Patent protection and EU competition law’, ‘Trade secret protection’. The majority of the lectures of the second part of the course are taught by guest lecturers.

Compulsory and recommended literature will be published on Toledo.

Digital course material (PowerPoint presentations, videos of the recorded lectures, compulsory reading materials, list of relevant legislation and case law) will also be published on Toledo.

The course is given in English. 

The lectures are based on the PowerPoint presentations and incorporate occasional questions/exercises to stimulate active discussions in class.

The lectures will be given on campus and will also be streamed live via Blackboard Collaborate or MS Teams (to be confirmed via the Toledo platform), to ensure that each student has an opportunity to actively participate in class.

The detailed instructions will be communicated via the Toledo platform.

In particular, the students are allowed to use legislation and case law. Slides, course book, articles and other related materials are not allowed.
