Aims
Learning goals
Students understand the relevant legal aspects of doing business online and have an insight in the European legal framework applicable to online business. Students are able to apply this knowledge to legal questions and challenges arising in an online business environment. (Competence level 3)
This course contributes to the following learning outcomes:
- The student can deal with complex problems in the domain of the intellectual property rights, media and / or ICT law that he / she has followed.
- The student can independently test research findings and situate them in a personally substantiated structure that makes an original contribution to knowledge.
- The student can adopt a critical position in relation to the domain of the intellectual property law rights, media law and / or IT law that he / she has followed.
- The student can communicate his point of view to colleagues in Dutch, French and / or English.

Content
The objective of this course is to provide a comprehensive understanding of the most relevant legal aspects of doing business online. Examples of possible topics dealt with in this course are:
- Electronic commerce in Europe: facts and figures, EU policies, general and sector-specific trends and developments
- Starting an online business in Europe: legal issues related to identity management and internet domain names;
- Which law is applicable to internet commerce? Which jurisdiction is competent in case of disputes?
- Market rules: competition law issues related to e-business with an overview of the most relevant EU cases in this area; regulation of specific online markets (e.g. health sector, pharmaceuticals, online gambling, etc.); legal framework of B2B markets; the EU 98/34 procedure;
- European electronic commerce directive (information society services, co-ordinated field, rule of origin, commercial communication, electronic contracting, regulated professions, liability of intermediaries);
- E-money and e-payment: internet and mobile payments, the EU payment services and e-money directives;
- Electronic commerce and taxation, incl. legal issues with regard to electronic invoicing
- Consumer protection: application of the EU legal framework of consumer protection and distance contracts to online commerce.
Recent regulatory and policy developments in Europe are studied more closely via class discussions and guest lectures by field experts.

Format: more information
The course modules will each last 3,5 hours, and will be a combination of lectures by the course holders, experts in the various disciplines and interaction moments (for instance class discussions or case exercises). For each module, students will be asked to read the preparatory material provided by the lecturers and participate in class discussions. Relevant course materials will be provided for each module.

Explanation
The written exam will consist of a combination of essay questions testing the theoretical knowledge and insight in the legal framework relating to online business, and practical cases testing the ability of the student to apply the legal framework to a concrete situation. Students may use the course materials.
