Learning goals

This course provides an in depth knowledge of labour law in the EU legal order.

Students will be able to:

- understand and explain in depth the thematic issues of EU labour law

- understand labour law issues in a comparative and EU law-national labour law interaction

- position EU labour law problems in a wider EU, national and global social policy context and historical context

- position and compare EU labour law with the Council of Europe, the ILO and the OECD

The course first focuses on the methodology of comparativism and the relevant research materials. International developments are analysed, e.g. the role of international actors, such as multi-nation-al corporations, international trade unions and employers' associations, as well as the role of international bodies like the ILO, the OECD and the EU. The case law of the European Court of Justice is quite often used as a starting point for the discussion on different topics.

Topics are related to:

• concept of worker or employee
• freedom of movement
• international contracts of employment and applicable law (Rome Convention, 1980)
• equal treatment
• sexual harassment
• affirmative action
• collective dismissals and company restructuring
• transfer of businesses
• European Works Council
• national information and consultation

Toledo readings, including a course syllabus of selected topics, literature, cases of the European Court of Justice, legislative documents including directives, regulations, treaties and selected texts: put at disposal of the students via Toledo.

Interactive teaching requiring the students to prepare for class.
